Furthermore, digital representations on screen may differ from physical items due to device settings and configurations.
We do not warrant that the appearance, texture, or quality of any products or services purchased by you will precisely match digital depictions or meet subjective expectations, provided they conform to the agreed product description.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.
Section 3 - Orders and Conclusion of Contract
The presentation of products on our website does not constitute a legally binding offer, but rather a non-binding online catalog. When you place an order via our online checkout process, you are making a binding offer to purchase. Thomas Sven Busch reserves the right to accept or decline your order for any reason at its discretion.
Your order is accepted only when Thomas Sven Busch accepts via an order confirmation email, or by dispatching the goods. We must receive and process your payment or payment authorization before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted, without prejudice to your statutory right of withdrawal.
In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy (Widerrufsbelehrung).
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Section 4 - Prices, Billing, and Taxes
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. All stated prices are final consumer prices and include the statutory value-added tax (VAT) applicable in the European Union, unless expressly stated otherwise.
Because our vases, lamps, and decoration objects vary significantly in size and weight, shipping costs are calculated dynamically at checkout based on your specific order. Unless otherwise expressly stated, posted prices do not include shipping, handling, customs, or import charges for destinations outside the European Union, which remain the sole responsibility of the customer.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our stores, and to promptly update such information.
Section 5 - Shipping and Delivery
Delivery of goods is made by shipping to the delivery address specified by the Customer within the European Union and internationally to selected destinations. Self-collection is not possible for logistical reasons.
We are not liable for shipping and delivery delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, risk of loss passes to you in accordance with statutory consumer protection regulations.
Section 6 - Intellectual Property
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Thomas Sven Busch, its affiliates, or licensors and are protected by German, European, and international copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.

No automated software, scraper, or "Agent" may access, use, or interact with the Services unless it explicitly identifies itself in HTTP requests via its user agent string ("Agent/[agent name]"), operates transparently without mimicking human behavior or bypassing CAPTCHAs, and complies strictly with our access policies.

Provisions that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall continue in full force and effect.
Section 16 - Warranty and Mängelhaftung
Statutory warranty rights (gesetzliche Mängelhaftung) apply to all products purchased through our store.
Since our items are 3D printed and hand-finished, each piece is an individual work of craftsmanship; minor deviations in texture, micro-structure, or finish are natural characteristics and do not constitute a product defect. Customers must notify us of obvious transport damages upon delivery, though failure to do so does not affect statutory warranty claims.
Section 17 - Limitation of Liability
To the fullest extent permitted by applicable German and European law, Thomas Sven Busch and its statutory representatives, employees, or agents shall be liable only for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit). For slight negligence (einfache Fahrlässigkeit), liability is restricted to breach of cardinal contractual obligations (wesentliche Vertragspflichten), the fulfillment of which is essential for the proper execution of the contract, and is limited to typical, foreseeable damages.
The foregoing limitations do not apply to liability for injury to life, body, or health, nor to mandatory statutory liabilities under the German Product Liability Act (Produkthaftungsgesetz).
Section 18 - Indemnification
You agree to indemnify, defend, and hold harmless Thomas Sven Busch, Shopify, and our affiliates, partners, officers, directors, employees, and agents from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of your breach of these Terms of Service or your violation of any law or the rights of any third party.

Da unsere Artikel im 3D-Druckverfahren hergestellt und handveredelt werden, stellt jedes Stück ein Unikat dar; leichte Abweichungen in Textur, Mikrostruktur oder Finish sind natürliche Merkmale und stellen keinen Mangel dar. Offensichtliche Transportschäden müssen bei Lieferung gemeldet werden, wobei das Unterlassen keinen Einfluss auf gesetzliche Gewährleistungsansprüche hat.
Abschnitt 17 - Haftungsbeschränkung
Soweit nach deutschem und europäischem Recht zulässig, haften Thomas Sven Busch und unsere gesetzlichen Vertreter oder Erfüllungsgehilfen nur für Vorsatz und grobe Fahrlässigkeit. Sie verpflichten sich, Thomas Sven Busch, Shopify und unsere verbundenen Unternehmen, Partner, leitenden Angestellten und Mitarbeiter von allen Verlusten, Schäden, Haftungen oder Ansprüchen (einschließlich angemessener Anwaltskosten) freizustellen, die aus Ihrem Verstoß gegen diese AGB oder der Verletzung von Gesetzen oder Rechten Dritter resultieren.
